RESOLUTION 90 -~
RESOLUTION INTEGRATING TERRITORY INTO AUBURNDALE
AND DESIGNATING ZONING CLASSIFICATION.
WHEREAS, pursuant to the provisions of Chapter 69-822
Laws of Florida Acts of 1969 (Section 137 of the Charter of the
City of Auburndale, Florida, as amended by said Act), a petition
has been filed with the Clerk of said City by MARGARET MYERS and
CLAYTON COWART, requesting annexation of property owned by them
as hereinafter described into the City of Auburndale, Florida;
and
WHEREAS, it appears and the City Commission finds that
said property is contiguous to the existing limits of said City
and within the City of Greater Auburndale; that Petitioners
constitute the sole owners thereof; that the property contains
less than ten (10) square acres; and contains less than ten (10)
qualified electors residing therein who are freeholders; and
WHEREAS, under the c1l'cumstances above, said certificate
of the Supervisor of. Election is not required by the terms of
said Act; and
WHEREAS,
a
sufficient
legal
description
has
been
furnished to the City of the area to be annexed and the quantity
of land to be annexed; and
WHEREAS, the GUy Commission hereby finds and declares
that such incorporation is deemed practical and expedient and in
conformity with the overall plan of. extending the boundaries of
the City of Auburndale into the City of Great~r Auburndale; and
WHEREAS, said property under the provisions of Section
27-7(e) of the Code of Ordinances of said City, is considered to
be zoned RS-3 (Residential). Now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
AUBURNDALE, FLORIDA,
that the following-described property,
situate, lying and being in AUburndale, Florida, to-wit:
Commencing at the Northeast corner of Lot 20, Thomas and
Horr's Subdivision, a subdivision of Polk County, according
to plat thereof recorded in Plat Book 4, Page 5, public
records of Polk County, Florida; run thence West 100 feet,
thence South 250 feet, thence East 100 feet, thence North
250 feet to point of beginning;
including all right-of-ways to adjacent roadways and canals; be,
and the same is hereby, incorporated into the City of Auburndale,
Florida, under the provisions of Chapter 69-822, Laws of Florida,
Acts of 1969.
BE IT FURTHER RESOLVED that the zoning classification
of. the above-described real property be, and the same is hereby
designated as RS-3 (Residential); and
BE IT FURTHER RESOLVED that the Mayor and the City Clerk
be, and they are hereby authorized and direoted to make
appropriate notation of the inclusion and zoning designation of
gaid property on the new official Zoning Map of the City of
Auburndale, Florida, pursuant to the provisions of Chapter 25,
Code of Ordinances, City of Auburndale, Florida.
ADOPTED at a regular meeting of the City Commission of
the City of Auburndale, on the
